The Greyhawk Grognard blog has this extract which reminds me very much of the way magic should be viewed in DCC RPG. I have no idea where the extract comes from, most likely the Greyhawk Grognard's own writing.

It's the business model that WotC uses that keeps me from becoming interested and returning to official D&D. I hate planned obsolescence. If a game is "all that" than why re-invent the game after three to five years? In twelve years WotC has produced 3.0, 3.5, and 4th editions. Sales ...

I playtested 5e his weekend and I saw influences from all editions and several D&D like games. Yes, the more I read, the more influences from other games I see. Mike Mearls even stated they've been playing Trail of Cthulhu which I can definitely see in some of the new rules they've talked about...

Maybe instead of a natural 1 the rule could be that a natural 20 gives one either a critical hit or allows the character to regain a lost luck point. I agree with all of your points. I had mentioned initially that the GM could control this by making things interesting for a player who tries it. I think you'll find surprise mechanic is a purely qualitative one, viz. "If the characters were not aware of their opponents (or vice versa), they are surprised." rather than a quantitative one (involving dice rolls and a DC).
